WORKERS’ COMPENSATION
In Missouri, the Workers’ Compensation Act provides benefits for employees injured while on-the-job. These benefits include:
- Medical treatment. The employer is required to pay all costs associated with the medical treatment of an injured employee.
- Temporary total disability (TTD). The employer will pay the employee for time the employee is unable to work because of an injury. The injured employee will not receive TTD for the first three workdays unless off work for longer than fourteen calendar days. The benefit is computed at two-thirds of the employee’s average weekly wage, capped by a maximum rate set by law, and is tax-free. TTD ends when the injured employee can return to work.
- Permanent Disability. Once an injured employee has received all the medical treatment possible, there will be a determination of any permanent disability. There are two types of permanent disability; permanent total disability (PTD) and permanent partial disability (PPD). PTD is provided when the injured employee is unable to return to work, and benefits are paid for life. PPD is provided when an injured employee can return to work, but has a lingering disability because of the injury. Benefits are provided based on a formula established by law.
Under the Workers’ Compensation Act, the employer has the right to determine the doctor from whom the injured employee will receive treatment. That same doctor will determine when the injured employee can return to work, and determine the amount of permanent disability.
